Georgia Tech provides automobile liability coverage for state‑owned, leased, rented, and approved personal vehicles used for official institute business. Coverage is governed by the State Tort Claims Policy (TCP‑401‑14‑19) and the General Liability Agreement (CGL‑401‑14‑19). The Insurance and Claims team supports departments with automobile liability coverage, optional physical damage coverage for Georgia Tech-owned vehicles, required documentation, driver resources, and incident reporting.
State‑Owned Vehicles
State‑owned vehicles are covered under the State’s liability program when used for official duties. A General Liability Insurance Identification Card must remain in each vehicle. Only authorized drivers who have completed required training may operate institute vehicles.
Optional Physical Damage Coverage (State‑Owned Vehicles Only):
Departments may elect to add collision and comprehensive protection for state‑owned vehicles by submitting the Automobile Physical Damage Agreement (APD‑401‑14‑19). This coverage is recommended for high‑value, frequently traveled, or specialized vehicles.
Coverage in Special Situations
- Healthcare professionals after leaving Georgia Tech: If the alleged malpractice occurred while performing official duties, coverage continues to apply. Any notice of claims or lawsuits must be sent immediately to the Office of Legal Affairs.
- Federal civil lawsuits: The General Liability Agreement may provide civil defense for unexpected and unintentional civil rights claims arising from workplace duties.
- Passengers in Georgia Tech vehicles: Medical payments are not provided. Injuries must be filed under the passenger’s health insurance or pursued through the at‑fault party.
- Uninsured/Underinsured Motorist coverage: Not provided. Workers’ compensation may apply if the employee was working at the time of injury.
- Personal property on campus or in vehicles: Not covered unless owned by the State and meeting the requirements of the applicable property agreements.
Leased and Rented Vehicles
- Short‑term rentals: Liability coverage is provided under the State Tort Claims Policy. Optional insurance offered by rental agencies should generally be declined.
- Damage to rental vehicles: Georgia Tech does not provide physical damage coverage; however, when renting through statewide contracts (Hertz or Enterprise), the Loss Damage Waiver (LDW) is automatically included.
- Long‑term leases: Departments must follow Georgia Tech procedures for coverage documentation and renewals.
Personal Vehicles Used for Official Business
Employees driving personal vehicles for work rely on their personal auto insurance for any damage to their vehicle. Liability coverage for injury or damage to others may extend under the State Tort Claims Policy when the employee is performing official duties. Personal vehicle repairs are not covered by the State.
